Ivy L. Nowinski

Ivy concentrates her practice in all aspects of aviation, business and commercial law.

Ivy has extensive experience representing and advising airlines and their insurers in connection with all aspects of commercial disputes, civil litigation, appeals, and regulatory compliance. Her experience includes assisting in providing comprehensive legal advice to a major military defense contractor, covering areas such as purchase agreements, disclaimers of liability, e-discovery best practices and preparedness strategies, and secured transactions. Ivy has also worked on litigation arising out of several domestic aviation accidents as well as an attack on a United States military contractor working in Afghanistan.

Ivy has federal trial experience and has spent years litigating commercial disputes and personal injury cases involving airlines, manufacturers, and their insurers in federal and state courts. She is experienced in all aspects of trial and pre-trial practice, with particular success with dispositive motions. She is also practiced in the field of alternative dispute resolution, and has achieved favorable solutions for clients at mediation in many cases. Ivy has unique and specialized knowledge of multidistrict litigation arising from mass air disasters, cases involving disputes between airlines and travel agents, and cargo losses.

Ivy has successfully served as counsel of record on a number of appeals in the Ninth Circuit Court of Appeals, the District of Columbia Circuit Court of Appeals, the California Courts of Appeal, as well as petitions for writ of certiorari to the United States Supreme Court.

Ivy has also advised airline, insurer, and manufacturing clients on a number of regulatory and compliance issues. She has experience advising insurers on their obligations under the Medicare Secondary Payer Act, as well as implementation of the mandatory reporting requirements set forth in Section 111 of the Medicare, Medicaid and S-CHIP Extension Act of 2007, both in connection with individual lawsuits and multidistrict litigation arising from mass disasters.

Ivy also assists clients with transactional needs such as drafting contracts, employment matters, and forming business entities.
